Welcome to My Matched Home. These Terms of Condition (the “Terms”) govern your access to and use of our website and home-matching service (the “Service”). By using the Service or submitting a request, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

My Matched Home helps connect prospective buyers with new construction homes and licensed home specialists in the Houston metro area. We are not a real estate broker, a mortgage lender, or a builder, and we do not own or sell the homes shown. Any purchase, financing, or contractual relationship is solely between you and the builder, agent, or lender you choose to work with.

2. Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the Service. By using the Service you represent that you meet these requirements and that the information you submit is accurate, current, and your own.

3. Consent to be contacted

By submitting your phone number and email, you expressly consent to be contacted by My Matched Home and our home specialists by phone, SMS (including autodialed and prerecorded messages), and email about homes and related services. Consent is not a condition of any purchase. Standard message and data rates may apply. You may opt out of marketing texts at any time by replying STOP. See our Privacy Policy for details.

4. Listings, pricing, and availability

Information shown on the Service about communities, floor plans, pricing, square footage, photos, and availability is provided for general guidance and is subject to change without notice. Homes may be sold, withdrawn, or repriced at any time. We do not guarantee that any particular home will be available or that any price will be honored. Always confirm details directly with the builder or sales agent before relying on them.

5. Acceptable use

You agree not to:

• Submit false, misleading, or other people’s information
• Use the Service for any unlawful, harmful, or fraudulent purpose
• Interfere with the operation of the Service, including by probing, scanning, or scraping it without permission
• Attempt to gain unauthorized access to any part of the Service or related systems
• Reproduce, copy, or republish content from the Service except as expressly permitted

6. Intellectual property

The Service, including its design, text, graphics, logos, and software, is owned by My Matched Home or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purpose of finding a home. All other rights are reserved.

7. Third-party services

The Service may include links to or content from third parties, including builders, lenders, and analytics or advertising providers. We are not responsible for the content, products, or practices of those third parties, and your dealings with them are at your own risk and subject to their own terms.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, My Matched Home disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, completeness, or reliability of any home, community, price, or other information shown on the Service. We do not provide legal, tax, financial, or real estate advice.

9. Limitation of liability

To the fullest extent permitted by law, My Matched Home and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed one hundred U.S. dollars (US$100).

10. Indemnification

You agree to indemnify and hold harmless My Matched Home and its partners from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
